TERMS AND CONDITIONS

DEFINITIONS: For the purpose of these terms and conditions, Obtainwise Limited shall be known as “The Company”.  Any person, company, organisation or agent contracting business with The Company shall hence forth be known as “The Purchaser”.  “The Goods” means any items sold or supplied by Obtainwise Limited under an Order; an Order means any request or order (via phone, web or fax) to purchase the Goods.

PREVALENCE:  These terms and conditions shall apply to all business conducted between the Company and the Purchaser. All other terms and conditions are expressly excluded, unless specifically accepted in writing by a director of the Company.

OFFER AND ACCEPTANCE:  A quotation does not constitute an offer and no contract exists unless and until there has been an acceptance by the Company of an order placed by the Purchaser. Written confirmation of order or delivery of order will constitute acceptance by the Company of an order placed by the Purchaser. The Company’s terms and condition will be deemed to have been accepted on the placement of any order or upon signature for the goods on any delivery document whether checked or unchecked.

PRICES:  Prices quoted are those ruling at the date of dispatch or as shown in our current price list, and shall be subject to revision if increases in cost or other circumstances arise. We reserve the right to change our current price list without notice. Prices quoted exclude Value Added Tax, Sales Taxes or any similar Taxes which will be charged additionally to the Purchaser at the rate ruling on the date of dispatch. Occasionally an error may cause the price/description published or advertised for Goods to be incorrect, in which case Obtainwise Limited shall be under no obligation to honour the incorrect price or Order.

MINIMUM ORDER/ DELIVERY CHARGES:  Our standard next working day carriage charge will apply on all orders below £100.00 excluding VAT.  All orders above a value of £100.00 ex VAT, (£50.00 ex VAT within the county of Northamptonshire, or Milton Keynes), will be dispatched ‘carriage paid’ to UK mainland destinations. However a delivery surcharge will apply to the following postcodes regardless of order value as this is imposed by our carriers: IV, HS, KA27-28, KW, PA20-49, PA60-78, PH17-269, PH30-44, PH49-50, ZE, BT, IM, TR21-25, PO30 – 41, JE, GU.

DELIVERY: Orders placed before 1pm will be dispatched for next business day delivery.  We are not responsible for any delays which occur whilst your goods are in transit with our courier.  In the case of a missing or delayed parcel, we will attempt to locate the parcel.  In the event that we are unable to locate your parcel, replacements will be sent. If goods are out of stock your order will be actioned as soon as goods become available to the Company and you will be contacted to advise of the approximate delivery date. The Company will make all reasonable endeavours to effect delivery, which shall be deemed to have taken place upon the signature of any delivery note or carrier docket, by any agent, employee or representative of the Purchaser. Claims regarding damaged goods or short delivery cannot be entertained unless noted at the time of delivery. Goods signed as “UN-CHECKED” will not be accepted in any claim for damaged or short delivered goods. Unchecked will only be accepted in case of incorrect goods being supplied.

FORCE MAJEURE:  Any delay or failure of performance by the Company of any of its obligation shall not constitute default by the Company or give rise to any claim for damage if the extent of such delay or failure of performance is caused or contributed to by any event the Company is unable to provide against. The Company will not be liable for any loss, damage or delays arising from (but not limited to) strikes, lockouts, cessation of labour, transport delays, accident of any kind or any other contingency beyond the control of the Company.

PAYMENT AND TITLE:  Payment is due on shipment unless a Customer has been approved for credit. The Company’s standard credit terms require payment within 30 days from date of invoice except in the case of transactions where different terms are agreed in writing. Risk in all goods shall pass to the Purchaser upon delivery but all goods will remain the property of the Company until payment has been made in full. This clause also has effect against third parties. The Purchaser grants irrevocable licence to the Company and its agents to enter any premises, with vehicles if necessary, for the purpose of taking possession of the Company’s property. The Company reserve the right to charge interest calculated (on a daily basis) at 8% over HSBC base rate, (from the date of invoice until the payment is received.)    Payment for Goods may be made by debit/credit card or electronic bank transfer (e.g. FastPay, BACS, CHAPS etc.).

SAFE HANDLING AND USE:  The Purchaser is required to read the instructions for use and/or any product information pertaining to the safe handling and use of goods. If the Purchaser has any doubts about the safe handling or use, they should seek advice from the Company prior to resale or use. It is the duty of the Purchaser to convey any instructions or product information concerned with the safe handling or use of any goods to their employees, members of the public and any third party handling or acquiring the goods from the Purchaser.

CANCELLATION, RETURN OF GOODS, CLAIMS FOR CREDIT RELATING TO ALL BUSINESS TO BUSINESS TRANSACTIONS:  The Company disclaims any liability for goods returned without the express permission of the Company.  Any goods ordered by the Purchaser and subsequently returned for credit will be subject to a re-stocking charge of 20%. Goods that are specially ordered for the Purchaser may not be returned for credit under any circumstances.

THE CONSUMER CONTRACTS REGULATIONS 2015: The Consumer Contracts Regulations 2015 for the purchase of goods by a Customer not acting in the course of a business and made over the telephone or through the Obtainwise website, or by mail order, are, with the exception of certain excepted contracts, subject to The Consumer Protection (Distance Selling) Regulations 2015.

CANCELLATIONS: Where applicable you can cancel orders in accordance with your rights under the Consumer Contracts Regulations 2015. 

To cancel your order prior to dispatch we advise that you contact us by telephone as soon as possible after ordering (Tel:  01604 758999).

For orders cancelled after dispatch you must follow our returns procedure.  Your notice of cancellation must be received within 14 calendar days from receipt of goods by telephone 01604 758999, by fax 01604 759979, by email sales@obtainwise.com or by post addressed to Obtainwise Ltd, Unit F, Pentagon Park, Barn Way, Lodge Farm, Northampton, NN5 7UW.  You are responsible for both the outgoing and return postage costs.

RETURNS : You may return your order for an exchange or refund within 14 days of receipt, provided the goods are returned in a perfect condition.

Once you decide to return the goods you must not use them and must take reasonable care of them while they remain in your possession. The goods must be returned to us intact and undamaged as soon as reasonably possible, and within 14 days.

It is your responsibility to pay the postage costs for any items returned to us. We advise that you use a recorded method of carriage for returning your goods. We are not responsible for items lost or delayed on their way back to us. In the event of a lost parcel, you as the sender are responsible for processing a claim.

Goods that are damaged due to delivery must be reported to Obtainwise Limited within 24 hours. Large Goods such as refrigerators must be inspected by the Customer on delivery for damage and an acceptance of delivery docket completed noting any damage that resulted from delivery. Goods that are missing from delivery must be reported to Obtainwise Limited within 7 days from delivery.

REFUNDS : All refunds will be performed via electronic bank transfer.  Please allow 7 working days for your refund to be processed.
